The following is the Digital Gamers, Inc. privacy policy. Please feel free to provide comments, suggestions, or criticisms. This policy may be updated from time to time depending your feedback and legal review. You may provide your feedback here.

Our Philosophy

We believe that everybody is entitled to their privacy. We believe our subscribers have the right to know why we collect certain personal information, and have the right to freedom from harassment by e-marketeers. The policy which follows lays out for our subscribers our use of the personal information we collect.

Personal information is information that identifies you, and that could be used to contact you online or offline. Personal information ranges from data such as name, email address, or social security number to highly sensitive information such as credit card numbers. In addition, demographic information such as age, salary, or buying habits becomes personal information when it can be associated with identifying personal information.

Digital Gamers, Inc.'s privacy policy may change from time to time. When the policy changes, the date of the policy will be updated. It is your responsibility to regularly review the policy for changes.

What Data Do We Collect, And How Do We Collect It?

Digital Gamers, Inc. collects a varying level of personal information depending upon the level of access you as a subscriber request to our services. We do not collect any information from anonymous users (users who for example play a parlor game for free without logging in). The minimum information we collect from a registered user is an email address, which serves as your user identification and provides us with a means to contact you for business-related matters; and your first name and last name, which provides us with a means to validate your request for certain changes to your account.

Users who wish to register for access to our premium services or download premium software (such as Digital Dominoes Deluxe) must provide address information. We will collect address information in order to comply with state laws requiring us to collect sales tax from residents of Boulder, Denver, or Lakewood, CO.

The only payment method we currently support is PayPal. Your email address, name, and physical address will be forwarded to our PayPal purchase page. Your actual payment information (credit card, bank account, PayPal account) will be collected by PayPal (and be subject to PayPal's privacy policy). We will not collect your private financial information (bank account or credit card numbers).

Users may register by filling out a registration form online providing their email address or may provide their email address when purchasing premium software. In both cases, we send a response to the user containing a one-time-only password that they may use to log in to the service. They may then use a secure form to provide whatever additional information is required for the level of service they desire.

Cookies and Configuration Files

Cookies are small pieces of data from a web site that are saved by your web browser. We may use a cookie to store your user identification (but not your password) on your computer, to simplify the process of logging in to our services through your browser. We send temporary cookies to your browser when you log in to the service to indicate that you are logged in. You can disable cookies in your browser; however, if you do so you will not be able to use many parts of our service, even as an anonymous user.

To use some elements of our service you must install a program on your computer. To simplify the process of logging in to our services with these programs we store your user identification (but not your password) in a file (a configuration file) on your computer.

We do not use either cookies or configuration files to collect any personal information.

Online Games

Information you provide in the course of playing an online game, including information provided when creating a character in our online roleplaying games, is public information. Information you provide in the course of playing an online game (including identifying personal information) is not covered by this policy.

Online Fora and Chat Services

We provide online discussion fora, and provide chat capability in certain online games. Information provided in these fora and chat services is public information and is not covered by this policy. Remember that any information you provide through these venues is visible to the entire world, and exercise appropriate discretion in the information you make public.

Job Postings

From time to time, we may post job openings and allow applicants to submit resumes online. Information submitted on a resume is not covered by this privacy policy. Information submitted on a resume will not be used for any purpose other than to evaluate a candidate for a position; however, that information may be disclosed to third parties if required by law, court order, or other government or law enforcement authority.

Who Collects the Data?

Personal information is collected by Digital Gamers, Inc.'s automated tools and Digital Gamers, Inc.'s staff members. Subscriber payment data is collected by Paypal. Data collected by PayPal will be used in accordance with PayPal's privacy policies.

Digital Gamers, Inc. does not outsource to third parties the collection of any personal information other than payment information.

How is the Data Used?

The email address you provide is used as the basis for your login and as a contact channel for business-related communication. You may opt-in to receiving additional information at your email address, including promotional information, newsletters, message board digests, and special services such as Starfire's Space War Review. Certain games may utilize email as an intrinsic part of the game; if you elect to enable email features in those games we will use your email address to send you messages from that game.

Your additional contact information (in particular your physical address) is used as a secondary communication channel for written communication, and may be used in conjunction with your billing information to validate your billing and ensure compliance with tax laws.

Does Digital Gamers, Inc. Share, Rent, or Sell Your Data?

By default, Digital Gamers, Inc. does not transfer your information to any other party for any reason other than those necessary for normal business operations.

What Does that Mean, Exactly?

We will not sell our customer list to other entities. We will not swap our customer list with other entities. We will not give our customer list to other entities for charity or goodwill.

So Then, Why Do You Say "By Default?"

We will transfer a subset of customer information to other entities under two circumstances. We will share information with third parties to the extent required by law, court order, or other government or law enforcement authority.

We will also provide you with a capability to "opt-in" to having your information shared with certain third parties. This will most commonly occur when you request access to a premium service that we offer under license from a third party; you will have the option to request that we provide your contact information to that third party. By default we will not provide your contact information to third parties; we will always require action on your part before we forward your information. Third parties will use information provided to them as a result of your decision to "opt-in" in accordance with their privacy policies.

How Does Digital Gamers, Inc. Safeguard Your Data?

Digital Gamers, Inc. will collect only that personal information necessary for our legitimate business purposes. We will maintain appropriate safeguards to ensure the security, integrity, accuracy, and privacy of your data.

Isn't That Just A Little Bit Vague?

Yes. We have no interest in telling a would-be attacker just exactly what and where they need to attack in order to try to compromise the security of the personal data we maintain.

How Can You Review, Modify, or Delete Your Data?

Digital Gamers, Inc. will provide a web-based interface through which you may review or modify most of your data. This interface will allow you to change some contact and billing information, as well as to opt-in to or opt-out of any newsletters, mailing lists, special products or services, or information sharing. Through that same interface you will be able to deactivate your account. At the time your account is deactivated, you will automatically be removed from all lists. Your information will be retained for a period of time necessary to meet our legitimate business purposes or legal obligations, and then will be removed from our active data. We will not alter or remove data stored in backups.

For your protection, the account email address and the name of the account owner may only be changed by written request with a notarized signature matching the name of the account owner. Accounts are non-transferrable and a name change request may not be used to change ownership of an account; it may only be used when the name of the account owner has changed (due for example to marriage), or to change the owner name on a family account to a spouse.

What If You Choose Not to Provide Certain Data?

Digital Gamers, Inc. provides varying levels of access to our products and services based on registration level. If you choose to play as an anonymous user and provide no information, you may use certain subsets of our services (such as online parlor games) but you may not access regular or premium services, and some features of services you can access will not function for you (such as accumulating a ranking when playing parlor games).

If you choose to provide only an email address, you will be gain access to an additional subset of our services, such as the ability to use the chat function built into the parlor games. However, you will still not gain access to most of the regular services or any of the premium services. If you do not provide your true first and last name, you will be unable to change your email address.

If you choose to disable cookies, then you will not be able to access any of our web-based products or services.

What About Children?

Digital Gamers, Inc. encourages parents to monitor their children's use of the internet, and to spend time online with their children. We strongly urge parents to teach their children never to provide any personal information online, no matter how trivial that information may seem. Digital Gamers, Inc. does not believe that children should use the internet without the knowledge and consent of their parents. Accordingly, Digital Gamers, Inc. requires users to state that they are 18 years of age or older when registering for our services.

Although we support discounted family subscription rates allowing multiple users for a single account, we only collect personal information for the primary account holder on a subscriber account. Although the account holder may configure additional logins under the family subscription, we do not collect any personal information for those additional logins.

If for any reason you believe that your child has been registered with our service, please contact our privacy policy adminsitrator, who will verify your concern and remove the information from our databases if appropriate.

Third Parties

Some of our pages contain links to third party web sites. We cannot make any guarantees about the degree to which those third parties protect your privacy. You should always read the privacy policy posted at any site that asks you for personal information.

Changes from 22 February 2006 Version

Altered the description of the data we collect to indicate that we do not collect any personal data from anonymous users.
